The investigation into the discovery of classified documents in President Biden’s home and old private office in Wilmington will be led by former US attorney Robert Hur, the attorney general confirmed Thursday.
Hur joins Jack Smith, who was chosen in November to lead the investigation into former President Donald Trump’s handling of confidential government papers, as the second special counsel assigned to oversee an investigation into sensitive documents.
“I will conduct the assigned investigation with fair, impartial and level-headed judgment. I intend to follow the facts promptly and thoroughly, without fear or favour, and will honor the trust placed in me to perform this service. Hur said in a statement following Garland’s announcement.
Hur was appointed hours after the White House acknowledged it had found a second set of papers in Mr. Biden’s garage in Delaware. Garland claimed the FBI began investigating possible misuse of sensitive information a few days after the original set of documents was discovered in an office Mr Biden used after he stepped down as vice president in early November. Garland stated that on Dec. 20, someone found the records in Mr. Biden’s garage.
John Lausch, the US Attorney in Chicago, was given the first order by the Attorney General to investigate the handling of the documents. He claimed Lausch had informed him last week of the need to hire special counsel, which led him to choose Hur for the position.
“This appointment underscores to the public the department’s commitment to both independence and accountability in particularly sensitive matters and to making decisions that are unquestionably guided only by the facts and the law.” Garland said. “I am confident that Mr. Hur will carry out his responsibility in a balanced and urgent manner and in accordance with the highest traditions of this department.”

Hur served as Maryland’s chief federal prosecutor from 2018 to 2021 after being elected by Trump and receiving unanimous support from the Senate. He was in charge “to set strategic priorities for and oversee one of the largest and busiest US law firms in the country,” This is according to a statement from the Ministry of Justice.
Maryland’s outgoing Republican Gov. Larry Hogan called Hur “a prosecutor of the highest caliber and integrity.”
“I have confidence in his ability to get to the facts and hold power accountable.” Hogan said in a statement. “No one is above the law in this country.”
According to the Ministry of Justice Hur served as Assistant U.S. Attorney in Maryland from 2007 to 2014 and Deputy Attorney General from 2017 to 2018. Before that, he was top adviser to Christopher Wray, the current director of the FBI, when Wray oversaw the criminal case. Department of the Justice Department and served as clerk to Chief Justice William Rehnquist.
Since the U.S. attorney in Maryland has authority over cases of a number of top-secret federal agencies, including the National Security ServiceHur has significant legal experience in handling classified information.

Hogan appointed Asian American Hur to lead an anti-Asian hate crimes working committee
Hogan chose Hur, an Asian-American, to lead a working committee to end anti-Asian hate crimes by 2021. Hur received his undergraduate degree from Harvard University and his law degree from Stanford University, where he served as editor of the Stanford Law Review.
Hur is referred to as a “lawyer attorney” by Paul Murphy, a partner at the law firm King & Spalding, who has worked with him in private practice and the Justice Department.
“He’s brilliant,” Murphy said in an interview Thursday. “He is incredibly hard-working and diligent. He has excellent judgment. You know, Rob enjoys a great reputation within the department and also on defense. Rob is objective, balanced and will be what I call a ‘balls and strikes’- approach in his work.’

Hur has “a wealth of experience,” according to Murphy, both as a prosecutor and as an attorney.
“He’s been on both sides of the table, prosecuting cases and defending cases, and so I think that gives him valuable perspective on the work he’s going to do,” said Murphy.
