California Public Defender Killed in Mexico: “Victim of a Horrible Crime” According to Family

On Tuesday, the family of an American tourist whose body was found in Mexico said they believe him “was the victim of a brutal crime.”

Elliot Blair, who was from California and worked as a public defender in Orange County, died Jan. 14 at the Las Rocas Resort and Spa on Rosarito Beach, south of Tijuana, on the west coast of Mexico’s Baja California peninsula.

Investigators first thought that Blair had died from a fallbut a specific injury to his forehead “would not have been caused by a fall”, told a local law enforcement official ABC news on Monday.

The Baja California Attorney General’s Office later released a statement saying that Blair had died “was the result of an unfortunate accident caused by the deceased falling from a third floor.”

The agency stated that the investigation is ongoing and that it is in contact with US authorities through the US Department of Justice and the FBI. “who work together and have information about the investigation to send to family who want it.”

A lawyer for Blair’s family reports this in a press release “Still have not contacted the family with this information.”

“The family is devastated that since this incident, no one from the Rosarito Beach Police Department, their district attorney or any other Mexican officials has reached out and spoken to them directly.” said the lawyer. “The only communication the family has received is through a connection to the coroner’s office.”

The coroner told Blair’s family on Monday “severe head trauma was the cause of death” and that the case had been forwarded to the district attorney’s office for a possible murder investigation, the attorney said.

“The family informed the contact that they would conduct their own independent investigation, specifically hiring a private investigation firm, hiring an independent forensic pathologist to conduct a medical examination, including their own toxicology analysis,” added the lawyer.

The attorney said Blair and his “loving wife,” Kim Williams, went to Mexico to celebrate their first wedding anniversary. The couple stayed in a room on the third floor of Las Rocas Resort and Spa, where they had stayed “many times” over the past five years.

The “incident” that led to Blair’s death “occurred in an open-air walkway outside the front door of their room,” the attorney said. Blair was found in the T-shirt, underwear and socks he slept in. The lawyer says he was “very familiar” with the hotel’s layout, spoke fluent Spanish and was “not intoxicated at the time of the incident”.

After doing a toxicology report, police said on Tuesday that Blair had a “significant” amount of alcohol in his system. Police also said there were no signs of a fight or argument in the hotel room, which they went back on Monday and searched again.

A spokesman for the US State Department said they are aware of reports that a US citizen has died in Rosarito Beach, Mexico. The State Department stands ready to help in any way possible, said the spokesman, who would not comment further out of respect for the family at this difficult time.

A representative of the Baja California Attorney General said Blair’s body is still in Mexico. A spokesman said investigators conducted a second check of the hotel and sent the evidence to a lab, where results are still pending. Blair’s family’s lawyer said Mexican officials have always said the body should be burned.

“Yesterday, during a conversation with the funeral home liaison, it was again suggested that he be cremated and the family insisted that his body not be cremated in order to allow for a thorough, complete and independent investigation.” added the lawyer.

Also, the attorney said Blair’s wife, who is also an Orange County public defender, “has been given different versions of what happened to Elliot.” The press release called Elliot “a brilliant lawyer with a bright future” and “a loving husband, son and brother”.

“The family, who have extensive legal training in criminal justice, sincerely believe, based on their initial investigation, that Elliot was the victim of a brutal crime,” said the lawyer. “Elliot’s tragic, untimely and suspicious death has left his family and community with a huge hole in their hearts that will never be repaired.”
